The Islamabad High Court has issued notices to the Ministry of Communications and other respondents in response to a petition challenging the additional motorway toll imposed on vehicles with an insufficient M-Tag balance.
According to reports, the petition contests a notification under which motorists with a low M-Tag balance are charged a 50% higher toll. The case was heard by Islamabad High Court Chief Justice Sardar Muhammad Sarfaraz Dogar.
Petitioner Challenges Higher Toll
The petition was filed by the Judicial Activism Panel against the notification issued on June 3, 2025.
During the hearing, the petitioner’s lawyer argued that the additional charge was arbitrary, excessive and lacked lawful justification. He maintained that motorists with insufficient M-Tag balances were being subjected to a disproportionate penalty without a reasonable basis.
The court observed that the disputed toll appeared to be part of a government policy and questioned the scope for judicial intervention in such matters.
In response, the petitioner’s counsel argued that policy decisions could also be reviewed by courts when they were discriminatory, unreasonable or contrary to the law.
Authorities Directed to Respond
After hearing the preliminary arguments, the IHC issued notices to the Ministry of Communications and other concerned parties, directing them to submit their responses.
The court has not suspended or overturned the additional toll at this stage. The petition remains under consideration, and the respondents’ replies are expected to clarify the legal and policy basis for charging higher tolls to vehicles with insufficient M-Tag balances.
