KP govt gets a notice for banning women’s bike rally in Peshawar

The Peshawar High Court has issued a notice to the city’s deputy commissioner and the provincial government for banning bike rally in the capital of the province, Peshawar.

On January 11, for the “Cycle Rally For Transgenders and Females”, the permission was given by the Imran Sheikh, Deputy Commissioner of Peshawar. This rally was going to be held on 19th of this month. But later it was cancelled, and this was again informed to the bench of the court which consisted of Chief Justice Waqar Ahmed Seth and Justice Ijaz Anwar.

Due to the “ pressure and the intimidation” from the clerics the race was cancelled. The NOC for the race was also not given due to this very reason said the petitioner and the Pakistan Development Mission. Names of KP Govt. and deputy Commissioner were also in the petition.

It was stated that excluding them from having the rally was unlawful and illegal. And the petition said that:

“Women are equal citizens of the country, and no one should be given the licence to [trample] upon their fundamental constitutional rights in the garb of religion.”

It was also argued and stated that such things should be prohibited since even in Article 4 of the Constitution of Pakistan if the law doesn’t prohibit something, then it shouldn’t be prevented from doing.

To bar the race to be declared as illegal, it wants the decision of the government decision. Even the petitioner wants that Govt should not only provide them security for another rally which is going to held later but they also demanded that if anyone tries to stop them from holding rally than government should take serious and immediate action against it.

By the 27th February, the government has summoned the reply of the government and the deputy commissioner since the petitioners have requested the Court that it should order the government to allow them to have a rally on 8th March, International Women’s Day.

The lawyer of the petitioner mentioned that the state should take against the people who are not only infringing the rights of others but also threatening others. But he also stated that instead of doing this, the govt not only withdrew the permission of the rally but also stopped the people who were being threatened.

The petitioner’s lawyer also stressed upon the fact that it is not a crime be it man, woman or transgender to ride a bike, under Article 4 of the Constitution.
