Thread: What to do after a accident - Pakistan

    Default What to do after a accident - Pakistan

    We all know what to do when you get a fender bender in a alternative country, but here in Pakistan, what is the procedure to go through?

    Aside from figuring out whose fault it is.

    I mean, what are the legal/common sense proceedings ( call a policeman, note down licence plate, keep other guy from running away...etc etc ) Then afterwards are there any court proceedings of such and how to handle them with minimal effort while getting fair compensation.( dont wanna put the other guy in jail, just want my ride fixed )

    And also how to legally deal and get compensation from a person who has no driving licence. ( i.e, boy racers )

    And how do i deal with the more....esteemed VIP personalities that may crash into me one day?
    ( im excluding the nice understanding fair chaps who are easy to handle )

    1.) the quiet housewife type, or young girl/boy just learning how to drive-timid and dosent put up a argument.

    2.)the person who was talking on his phone and then crashed into you

    3.) the angry terminator wannabe who starts a argument in the middle of the street

    4.) The " Its not my fault! it could never be my fault! , I am a fault free GOD! " types who will not agree to the law becoming involved, are reluctant to accept fault and will make a run for it if possible

    5.) the gang bros- other vehicle is full of young men, all unreasonable.

    6.) The guy in the luxury range rover ( probably your fault anyway, a person with a luxobarge in pakistan drives like he is the embodiment of caution itself

    7.) the boy racer on a motorcycle or a ( usually ) old mehran,cd70 or civic with stickers, a useless spoiler, and no licence.- especially prone to running away when alone, might attack if in a group. Also known for having no engine oil in their car and a leaking radiator.
    Cosmetics are everything, the vehicle is abused and treated like a toy.

    8.) the victim. Its his/her fault and its YOUR car that is smashed up but they wont shut up about the 1 cm long cut on his/her forehead. ( or the person who says his wife is in labour, his parents are dying at the hospital, blah blah )

    Why u want thana kutchehry. Suppose if your loss is 100,000 rupees you might end up spending at least same or more on litigaiton and waste all day sittinng on a bench outside the court and have to give bribe to everyone from peaon of judge to his driver and clerks and munshi and so many other tom dicks and harries, the file carrier, record keeper.

    Have never heard someone filed a case in court and won damages.
    Be polite on the road. Always give way to others, particularly ambulances and pedestrians.

    like already mentioned police guys will tell u "apna apna khud kr lo"
    people who have contacts will get ur car locked up n u as well n will get compensation from u as well

    i remember seeing an accident, both parties were blaming each other for the hit n no one was admitting their own mistake
    police arrived n the traffic police as well
    then traffic police figured from the situation who could be at fault n gave their verdict n then that party agreed to pay up, end of story
    so this also happens

    Depends on what you are and who you are dealing with.

    If you are a resonable person you will own your mistake and pay up. And the other way around see your damage is just few thousand rs you will let the other guy go.

    If no one is resonable you will park your car in middle of the road argue like Aholes and keep blaming the other guy... and even get into a fist fight... then crowd will so sula safai... and eventually talk the guy who hit into paying.

    In my experience of driving for 10 years... there was 1 event on which an Ahole hit and ran away... it was a mini pajero..

    And all other times damage to my car was scratches and dents and I just let the guy go because when ever I get off their first word was sorry.

    Like everyone said don't bother involving police in minor accident,if there are God forbid injuries then it's different story.To be honest you will be lucky if you get paid any compensation at all.If a public transport or heavy goods vehicle hits you then most probably it'll be driven by a driver who could never pay you any money whatsoever because he hasn't got any and the owner will most likely be a VIP sort of guy so no chance their either.
    And most importantly watch the crowd,that can be very intimidating,a lot of cases you can easily work things out between yourselves but opinionated crowd gathered at the spot makes things go worse from bad.

    A biker hit my parked car in a proper parking while coming from the wrong side and broke the genuine tail light of my Lancer, keeping in mind that the car is a part of our family and we have kept it lovingly, anyhow, I managed to pull out the stuntman's key and called the police in the meanwhile. They took a while to come and in the meantime a lot of idiots gathered around me and said "maaf kar do ghareeb aadmi hai" BS, I said itna tarass aa raha hai to nikaalo 10,000 I will forgive him. Among them was an imbecile who started fighting with me, I said out loudly to him "gari meri nuqsaan mera tum hotay kaun ho beech mein bolnay walay", that shut him up quite well, not to forget the fact that the biker started acting like he was crying and begging for forgiveness. A man even said that why have you parked here, I was like WTF is wrong with you. I took the biker to police station when cops arrived, they were very helpful and made all those jaahil supporters run away, a k3wL type of brother showed up after around 45 mins of keeping us waiting and gave us his NIC and said to contact him the next day for repair work. When I contacted him, after a few messages, that a-hole turned off his number and never responded again.
    Such bikers have made their tendency to cause damage to others and run away like nothing happened, and if they get caught, our "jaahil" awaam will always come out to support them. No offense to anyone but agar yeh itnay ghareeb hain to itni jaldi kis baat ki hoti hai keh koi traffic law inn par applicable hi nahi hota and all the blame goes to the car owner. In a traffic jam, they go zigzagging like a mosquito specially many of them sound like mosquitoes as well with altered silencers, and shamelessly scratch people's cars and many times they do it deliberately out of jealousy or I don't know what do they have in their minds. Hum car owners to bewaqoof hain naa jo araam se wait kartay hain traffic clear honay ka, such people are shameless, ignorant, jealous and what not. They also bring a bad name to those who ride a motorcycle the way it should be done, in the left most lane and at a decent speed, and do not remove their side mirrors.

    It's a result of our national pastime - being envious of everyone in a better condition than you. If you have a car, you obviously must be do-numbery or ameer-baap-ka-laadla, so you deserve to be humiliated and insulted. No one wants to believe that people can get wealthy by simple hard work.

    In most cases we don't really have time to cover our own loss. So you decide at the spot, whatever it be and don't involve the police unless it's a major blow that calls off that day of yours from anything else you wanted to do.

    Once my C-180 was banged among some 5/6cars on LAhore canal due to a kid that fell off from his bike some 4 cars ahead of me. The first 3 cars hit each other and i was the second last among all 6...
    I wanted to pull out the keys of iDSI that hit me from back when the civic boy whom I had hit from behind came for his broken bumper. That iDSI guy slipped while the civic guy gave me his address/number and took mine to compensate his loss. I had to return home because of a broken headlight while I was headed to islamabad.
    I was always told that it's the one hitting from rear who's always at fault...
    I went to his address at night but couldn't figure out from peeking at his fate whether he got his bumper fixed or not (that was so childish on my part). The next day we met, he said he won't accept repair so either I pay him or get his bumper replaced from Honda. I paid 5000 for the new bumper and its paint.

    Once I was waiting for my turn at a MP check post, this time leaving Multan for LAhore. Suddenly I felt a bang and guess what, a meh ran hit me from back while I was literally stopped at the queue.
    As I got out immediately, the guy was talking on mobile that I took from him immediately. He said "Bhai brake he nai Lagi" and I was so angry for that lame excuse.
    One MP personnel requested us to get aside that I did immediately.
    He noted down our details and asked me whether I wanted to call the police or settle things ourselves.
    I asked for the compensation of my broken bumper, meh ran guy told me he had only 300rupees in pocket.
    I took out his original CNIC and number as he agreed to pay the loss later and continued for LAhore.
    I called him from LAhore that I am getting the bumper fixed, not replaced but would take the amount for repaint and he said OK and asked me to wait at Kabirwala (before Multan) on my return. I called him as decided but he never answered afterwards... I don't have time to follow anyway.

    Once a chingchi was driving so close me in a bazar, I could see him I rear view mirror and thinking it would hit me. I did not have space to let him go, Suddenly the car in front of me stopped while I was hardly at 20-30kmph and had to stop as well. That chingchi hit my civic leaving scratches at the trunk, I got really annoyed and wanted to pull out his keys when he almost went for a fight straight and left dirt marks on my white shirt as he held that... The mob requested to forgive him and I felt really helpless....

    Calling the police is not the solution as once I was going to the doctor as per appointment while a mehran banged my rear left door out of no where. He wanted to put it on me but the witnesses immediately got involved and told him it was mistake.
    I asked for my loss compensation but he said "Mera zyada nuksaan huwa hai" that made me call the police.
    They reached at the spot in 10mins while called twice to know my exact location. Police also requested is to settle down the affair but when we could not then he announced, "let's go to the police station and file some 740 ka case and then we will investigate"...
    I agreed while I never wanted to do that. A guy from mehran again requested to let them go and I agreed to that asking police if they did not have any objection. I wasn't sure they would let us go like that...

    So it vary case to case but most of time you should avoid a fuss, it's your luck that you encounter a reasonable person or some more obvious fuss-creators...
