There already is a law governing such practices "The Punjab Consumer Protection Act 2005" . Don't know if any such law exists in other provinces.
Duty of disclosure.โ (1)
Where the nature of the product is such that the disclosure of its component
parts, ingredients, quality, or date of manufacture and expiry ***is material to**
the decision of the consumer to enter into a contract for sale, the
manufacturer shall disclose the same.
It's obvious that disclosure of price and specifications of a car is material to the decision of the consumer to enter into a contract/purchase.
Honda Atlas Cars is in violation of the said act esp the various clauses which fall under "Duty of Disclosure". They are repeatedly getting away with these violations; As they have never been sued before because majority of consumers aren't aware of their rights as all such laws are written in English; use legal linguistics and have never been advertised in media regularly.
However, I am sure that Honda would have included/sought exemptions from prosecution against the said violations embedded in fine print in the PBO document. Even if that's the case and consumer courts don't entertain pleas on basis of that; High Court will definitely intervene if a consumer files a writ petition as PBO isn't a legal instrument.
I think that fellow pak-wheelers who are lawyers should take this up as a pro-bono law suit as they can manage such litigation in minimal costs and they will be doing a great service for the general population. It will also improve the image of lawyers community even further for raising the voice for protection of consumer rights.
Any dynamic, energetic and motivated Law Firm can turn this into a multi-million Rs class action dam-rages law suit. As hundreds of potential customers would be willing to become complainants if such a class action law suit is initiated.
Lawyers can comment better; but there is a definite violation of "The Punjab Consumer Protection Act 2005" at multiple levels...
Disclosure of price, specifications etc is mandated by law.
