No, as I said the driver ahead can not make a mistake that is a clear cut rule. The only way the driver ahead can be penalize is when he is start weaving on the straight which was not the case in Massa/Hamilton case.
Yes, Massa moves on the inside which was opposite to what Hamilton did in Belgian GP against Kobayashi but the circumstances are different. Massa's moves was to take a left hander turn while Hamilton's move was total opposite of what kind of turn was coming ahead. For taking a right turn he moves to left which makes that move stupid.
As for Johnny Herbert, the person on whose advise it was been determine that Massa should be penalize certainly can't say that Massa does not deserve the penalty because if he says that Massa did not deserve penalty it will raise questions that why he gave a different view in the stewards inquiry.
David Coulthard has said during the race that it was Hamilton's fault who can't wait for a small amount of time just to make a correct overtaking move and that is the real problem this season for Hamilton he is trying to make suicidal attempts of overtakings which are not going his way most of the times.
