Dear OP; the short answer is that car can not be transferred on your name or any body else name, and yes one can get the duplicate file and insist on getting it from original owner.
Before I elaborate on the process of how does one go about getting the duplicate file but first you should know what are the contents of return file if you are original owner,
1) Application for registration of vehicle - Form-F.
2) Copy of National Identity Card of Owner (In case of individual).
3) Original Sales Certificate of Vehicle.
4) Original Sales Invoice of Vehicle.
Aforementioned contents are for the vehicle which is in original owner's name, now lets suppose the vehicle is sold by original owner (like in your case), then there would be following additional items present in the file as well.
5) Transfer Deed (on Rs. 100 Stamp Paper)
6) T.O. (Transfer Order) Form. (on Rs. 100 Stamp Paper)
7) Documents showing sale of vehicle by original purchaser.
8) Copy of National Identity Card of original purchaser (In case of individual).
Now let's start on the process of obtaining duplicate file, first of all the owner shall go to nearest police station and lodge FIR of loss of documents, after getting the copy you will be advised to post advertisement in news paper and then wait for at-least 15 days time, after that you will be armed with the FIR report and news paper add copy now the owner will visit the dealership where that vehicle was purchased originally, when new vehicle is purchased four copies of each of these documents are present,
(item # 3) Sales certificate of vehicle
(item # 4) Sales invoice of vehicle
What happens to the additional copies is that two are kept at the head office, while third is for the dealership record, now when you will visit the dealership and let them know about the quandary that you find yourself, there you will need to submit the application along-with copies of FIR & newspaper add then your application will be forwarded to head office and hopefully you will be granted a NOC from the Honda, which will state that vehicle of such and such chassis #, engine #, make & model is indeed sold to person so and so (original purchaser).
Now armed with that additional proof from the manufacturer, the owner will go to Excise and taxation office, there a separate case of duplicate file will begin, as there are around 120 districts of Pakistan where motor vehicles are registered, so they will provide you with a per-forma that you will need to fill and send the registered mail to those 120 vehicle registration offices and from all of these offices your concerned ETO office will receive the NOC stating that no vehicle of such and such details has entered in their record nor shall it will happen in the future, when those NOC are arrived then ETO office will issue a duplicate file.
Hopefully this process will not take more then 8 to 12 months, after which your vehicle is ready to be transferred to any person in Pakistan.
Hope its helpful.
