Buying car when car is not registered on present owner's name

Looking at a car. Person who owns it, says it's not on his own name.

Says actual registered owner is a "friend" and will help transfer the car.

How to go about finalizing this kind of deal, what precautions to take and ensure smooth, legit buying + transfer process?

Obviously first will be demand to see the registered owner and meet him, with original CNIC?

It is Lahore registered. So, I guess it will require BIOMETRICS?

Having a car on one's name is something else (and its the best, as it automatically covers next thing); having proof of ownership is other thing.

No doubt, if seller, at the time of selling an automobile, is also the owner of that automobile and has valid smart card / registration book, then its the best thing.

If seller is not the owner of that car i.e. he does not have any documentary proof that he owns it; a stamp paper, etc. or any registration doc. / smart card, etc. which depicts his name as the current owner, then I'll sincerely suggest to simply walk away, irrespective the offer is quite lucrative.

Ask him to give you proof of ownership of the car, and valid guarantee / surety that his friend will be definitely there at the time of transfer of ownership.

Last year, I intended to buy a Honda Civic 8th gen. Karachi registered. It seemed neat and clean and offer also seemed reasonable, however, seller was showing lots of "Taizi".

He could not satisfy me regarding any proof of ownership, and then when I said that since you do not have any proof of ownership and car is also not registered in your name, so I'll not transfer the amount in your's account, rather the person's who owns it, and you can settle with him.

2ndly, he'll have to fully support me regarding transfer of ownership.

He got extremely infuriated / offended and his tone also changed immediately. He said:

"!... بھا ئی آپکو گا ری آپ کے نام پے چاہیے نا ، یہ میری ذمہ داری ہے ! میں آپکو کروا دوں گا آپ پریشان نا ہوں..."

I politely winded up and dropped the call.

Even if you are interested in buying it at any / all cost, thoroughly check the car for any / all issues (Electrical, Mechanical , Chassis / Engine No., etc. and their condition) and ensure that car is trouble free from any legalities (verification of Police record, etc.). Freeze / finalise the deal, and also meet his friend.

Make some token money, and ask him to come to the relevant excise office with his friend, along with car, and help him in transfer of ownership.

Pay him the amount immediately / on-spot at the time of ownership of car (decide the payment mode prior) and take the car's custody immediately.

(May be I have missed something, as I have never done this or experienced something, so I would suggest the experts to add something if I missed, or if this suggestion is all wrong, please flag for deletion)

You mean the guy didn't have original registration book plus sale agreement with him?

If I can recall correctly, he had registration book, but on it, he was not marked as the current owner of that Civic.

Anyone can have a smart card / registration book (its not that difficult), even a thief, if he steals a car and it has the registration book inside it as some owners do it, i.e. keep all the original docs, file, registration book, etc. in the car.

Don't know why some people do it?

Totally agreed.

It's a transaction of millions of rupees these days. So everything from the seller's side should be crystal clear. It is seller's responsibility to show all legit documentation at the time of deal finalization.

Totally agreed Sir, but as is said and quite common here:

"... مشتری ہوشیار باش ..."

and

"... جاگدے رہنا ، سادے تے نہ رہنا ... "

So a potential buyer needs to be multiple steps ahead of the seller, to avoid any fraud, loss, scam, etc. as most of the sellers seem unfair.

The seller, whose ad description is not fair; selling accidented cars as bumper to bumper genuine and in original paint, driven by an Army Officer (when he might be the 1st owner and had sold his car many years ago, but still, Army Officer driven), 1st owner (while car is on open transfer letter, and only ALLAH ALMIGHTY Knows, how many owners have switched in-between), what else can be expected?

I usually walk away from such cars, army afsarr look at cars like subordinates and just flog them to death. 100% of times all the "army afsarr" cars I saw in Pakistan were rolling piles of scrap metal.

doctors dont have time to wash their own faces or iron their own clothes, You are expecting them to take care of a car?

this list is my own experience that if they are part of an advert they are all faulty cars.

if they have receipt from the company than its fine but without it he might be lying or scamming as i recently bought a civic and he still had all the receipts from the day he bought the car

without annoying the person.

agree to the negotiated price, and offer to pay 100% in the name of person whose name appear on papers, as owner, through the bank draft only wait for reaction. I'm sure you will walk away.
