I was wondering how can one identify the unethical act of "Top Marna" ,as people would to call it, by property dealers. Let me illustrate with an incident that occurred with my cousin.
My cousin had planned to purchase a plot in some private housing society. He had several talks with a dealer over a specific plot. After site visit and plot file verification the deal was settled for 50 lakh. He gave bayana of 50000 and promised to pay the full amount at a specific date. Now this is where it gets interesting. The dealer cleverly said my cousin should transfer 47 lakh something to the account of the person who had the plot file and remaining should be paid to the dealer, since according to them, they had themselves given some bayana to the owner of the plot file just to facilitate and quicken the transaction. Now I know my cousin should have noticed that the actual price of the plot file was 47 lakh something and not 50 lakh which was communicated to the owner of the plot file by the dealers. But he still went with the transaction willingly. On top of all of this, he also paid commission to the dealer. Now I know this is highly unethical but is it illegal too?
And most importantly, how can one identify a dealer overcharging in a plot, car without the knowledge of seller? What if the seller is already involved with the dealer in this unethical practise. Both ways, the buyer will face the loss.
