Govt. penalty for late delivery (more than 2 months)

Hi members. I want to confirm if I am eligible for the compensation/penalty amount from Hyundai as they are delivering my car after 2 months even I have paid the full amount. As you can see, the booking date is 20 Dec 2021 and the delivery month is March 2022 which is way more than the 2 month period the government has provided to the companies in case of full payment. Can someone tell me if I am eligible for the refund amount from the company and what is the procedure to claim that?

Any company is liable to pay you the compensation/penalty amount once the 60 days time period passed since the tentative delivery month mentioned in the PBO.
In your case, it is March 2022. So, it means that if your car won't get delivered by the end of May 2022, then you're eligible to get the compensation cheque from the company as a penalty and I think at the back of the PBO which you have signed already before getting it from the dealership, in the terms and condition, this is mentioned in very clear words.

As per govt picy. You are eligible for compensation from 20 Feb Onwards. Companies just play woth us because we dont know the rules clearly. It doesnt matter which delivery month they give you. As per the rule, they must lrovide veh within 60 days of full payment, if nog, then they must pay compensation.

There is no backside of my PBO. I can call the dealership tomorrow to ask it but as per my research, the 60 day period starts from the time of booking and in worst-case scenario, they can consider the start date after the pay order is cleared. This penalty from gov. was made to lower the on culture from the dealerships and if they are going to give us 3 months time on PBOs, they can definitely still sell the cars on money which they get early on their showrooms.

I completely agree with you, but this is the game these companies are playing with the common man who's trying to buy the new car with his hard-earned money. I suggest that you should discuss in detail with the dealership officials from where have you got your car booked and according to the government policy, yes you're absolutely right in saying that the companies are bound to pay the compensation cheque once the 60 days period passed from the date of your full payment, but usually they make excuses to extend that date as much as possible and the easiest excuse that they make is that 60 days counting starts from the date mentioned as the tentative delivery month in your PBO. I do wish that you will get your car sooner than you expected.

Can you please guide me how can I proceed it with dealership as they are saying that "This way every person can book with full payment and get a payment". And if they don't cooperate with me then how can I claim it?

Bhai, the ruling is attached as below. If they say everyone can do it then its everyone's right. They must not make full payment bookings early on if they cant deliver. Thats why companies usually book on partial payments.

I got my FWD Sportage delivered after 5 months of full payment and it took me atleast 20-30 calls with the call center people to finally agree that in my case, the 60 days rule started from the date of booking (full payment).

They all have been trained to play around with the words and to shut you up by saying that the company gave you a delivery month of XYZ and the company is only liable to pay the penalty after 60 days of Tentative delivery month and it's mentioned on the PBO blah blah blah - That is incorrect.

The 60 day rule triggers from the date of full payment and the OEM is liable to pay the penalty from the 61st day of full payment.

In my case, the compensation check I have been told was dispatched on the 23rd of December which I have not received yet; mind you, I have been up their case since early October. I keep asking them for a check # or the amount but they are giving me a hard time even giving that information out that it's against the company policy. Bullshit. It's like, the system is designed to keep the end-user uninformed.

Yes, this is the sad reality. They are making lame excuses with me too. I am not sure if complaining on the citizen portal would help? I had good outcomes with my other complaints there.

Good Luck getting your compensation cheque from the company. I hope that you'll get it soon as normally it hardly takes a week for the compensation cheque to reach the hands of the customer.

I know they’re giving me a run around for nothing but koi nai, lets see how this issue pans out. Meanwhile i’ll keep on being a leechar till i see the check.
