Motorbike Ban over Motorways - Nov 2022

As the Supreme Court has overturned a four-year-old high court order and endorsed the government's earlier decision to ban motorcyclists on motorways, heavy-bike riders are being denied permission to ride on motorways effective Nov 18 2022 .

A three-member Supreme Court bench headed by Justice Sardar Tariq Masood allowed the appeal moved by the Ministry of Communications and the National Highways and Motorway Police (NHMP) inspector general against a decision of the Islamabad High Court (IHC) that was issued four years ago.

In its December 10, 2018 verdict, the high court had ordered an improved standard operating procedure (SOP) to ride motorcycles on the motorway.

Setting aside the high court order, Justice Muhammad Ali Mazhar, who authoured the nine-page verdict, held that the motorway ban on motorcycles under Section 45 of the National Highway Safety Ordinance 2000 (NHSO) was within the law and couldn’t be construed as a violation of any fundamental right to life or liberty.

Besides, this section was not challenged before IHC as being ultra vires (beyond the powers) of the Constitution or the NHSO, he wrote.

big bikes should be allowed but for a shorter run...for eg pindi to chakri only

Just as mobile phone were banned and we were left way behind because control measures were not there, similar decision, cannot control bike traffic, just ban it.

very nice move to ban the menace of 2 wheelers over motorways.
@hash4u sir irrespective of bike value, the mindset, traffic sense, right of way and personal safety is of key importance., which is absolutely invisible with every 2 wheeler on road in Pakistan, be it a China 70 or a BMW 1250 GS.

Riding a Rs. 2 million worth 2 wheeler, wearing 25000 worth leather outfit feeling Hercules over 2 wheels in their mind all such people believe they are center of attention & own the road to go around between vehicles in any lane as they please. No Sir not on motorways at least. Good Move by court.
