Date of your hearing in Sessions Court is Oct 3rd or Nov 3rd? Honorable Judge has written 110 as the month. So please get it confirmed. Phir hand na ho jaye.

First, obtain a copy of other party's appeal. Then get a lawyer engaged from Faisalabad or preferably Islamabad, and send vakalat nama on the first hearing. Take time till next hearing to submit your reply.

Please ensure to include your input in the reply. Don't depend on the lawyer for that, entirely. And please also challenge lower Court's inclusion of bail bonds of Rs. 500,000/-. Otherwise you won't be able to counter it if the case goes to the level of High Court.

what i can see is 1 added later the date is 3/10/2020 to make it disputed and divert 1 is added to confuse.

I meant to say that the lawyer applied for appeal after 2 hours after the courts verdict. I was told by my lawyer that it will take 3 to 4 days in order to get an attested order, Meanwhile the other lawyer who is in possession of the car applied for an appeal.

Date of hearing is 3rd October. I will definitely challenge the bond request. I work 6 days a week and its hard for me to be present in court on every court hearing, therefore I tried arranging a trust worth lawyer that my friend vouched for. However, that was not the case when both lawyers ustad came out to be same person and my lawyer started favoring the other lawyer.

What If I get the accused arrested for stealing/fraud/forgery?

The MRA clearly mentions that a fraud was committed.

The other party registration was revoked. FIR still remains active and the case is still pending.

We have the arrest warrants for the accused (nephew of the lawyer) who sold this vehicle to the Lawyer according to police report when vehicle was first impounded.

I have also applied for arrest warrants for the lawyer.

The Magistrate order/police/MRA stands in our favor.

Will the session judge court not verify the paperwork (MRA/Police report/Majistrate order) and blindly hand over this illegally obtained vehicle to this lawyer?

What will be this lawyer stance on this petition? This vehicle in question was stolen not sold.

Will the judge still favor the criminal?

two elderly people got infected with covid...

both admitted in medical facility, one is taken care of by a family member while other by medical staff..

you have a strong case here, but please take care personally, and don't ignore the loopholes, specially not the ones which were identified to you..

you have solid reasoning for your case, but if u present it in front of judge instead of Pakwheels, you wud get the desired result swiftly.

please get a slightly less unbiased lawyer (best bet u can have) and watch him closely, believe me you have more knowledge...

also present the case with ur lawyer to judge, yes u can also represent urself, tell him abt facts also that u dont have free time to visit time and again and all other arguments..

What I am trying to say is Police FIR/Motor registration Authority order and 2 judgements orders from the court will again get challenged?

Why aren't the orders from all these institutions not good enough?

Can't the judge not revoke his future appeals?

Brother, it has already happened. Welcome to the judicial system of Pakistan. You'll enjoy your stay here unless you try to stay as close to reality as possible.

Your problem has been aggravated many fold only because your opponent is a lawyer (not an ordinary litigant). So please take note of this. If you get a judgment in your favor from Sessions Court (Insha'Allah), the other party shall challenge it in High Court, because he's a lawyer himself. He doesn't have to pay any fees and can easily manage the affairs with the court staff, which you can't.

Please share copy of the appeal, so that we can solicit an expert legal opinion for your peace of mind till the time your new lawyer prepares a reply.

I can understand your feelings and well wishes but in a court of law the litigant cannot plead his own case if he has engaged a legal counsel to present himself. You can speak yourself only if the judge directly asks a question and seeks a reply from you. Even then a clever lawyer shall not let you speak directly so as not to get exposed, give a weakness to the other party, or to annoy the judge.

I'm heading over to Mardan on this upcoming hearing, I don't have the copy of the appeal just yet. but he made an appeal to challenge the Magistrate judge order and to review because he is the rightful owner purchasing this vehicle from a 3rd party (the person who is currently in prison for forging a passport and drugs related case) and he is the rightful owner.

I don't think the judge will overrule MRA/Judicial order and 381a FIR and go against the government institutions. its the duty of the judge to investigate this issue and verify the 381a FIR and Excise order.

I can attach this guy criminal record with the stamp paper who sold this vehicle when I submit my response.

This Ayub Khan is the one who sold this vehicle.

This appeal will hopefully get cancelled once its reviewed because (Ayub Khan) did not have any right to sell this stolen vehicle because neither he had the ownership nor they can prove that they purchased this vehicle from the rightful owner.

Also according to the records, this vehicle was transferred from the 1st owner directly to the lawyers nephew bypassing our ownership. Its already proven by MRA the registration book was tempered with.

All this was done after this 381A FIR was registered.

Will his right for appeal not get cancelled?

He has no position to prove his rightful ownership (3rd party buying) and he can't prove that it wasn't a stolen vehicle because of the Active FIR registered before the date of purchase.

Even If he takes this case to high court

What document can he provide to claim this vehicle or anything else in this matter in favor of his case?

Also, the lawyer nephew have a government job in KPK, I can also make things messy for him if he wishes to and get him fired and arrested. However, I am not a bad person and I will give him one last chance when I visit for next hearing.

I don't plan on losing @uzeemujeeb my hard earned money along with the car .

Stay strong. I dont have any experience of these things but my personal opinion is that this appeal and any potential subsequent appeals will all fail but this rogue lawyer will keep on doing these to break you. he thinks that at some point you will get sick and tried of pursuing him and hence will either come to an out of court settlement with him or just stop pursuing him cause its not worth it.

my advice to you will be to stay strong and keep pursuing, these people need to be taught a lesson and may Allah Taala make everything easy for you and help you.

where you registered FIR when the vehicle was stolen. If in Faisalabad then take Police from Faisalabad to Mardan after proper legal action and took the vehicle as well as the person driving that vehicle with the help of local police. You have already lost your vehicle and now further expenses and trips to Mardan. Our judicial system is like this we all know but there are ways to trap it inside. You should consult the lawer in Faisalabad and take action through police. They will guide you how to bring vehicle in Fasialabad.

your version & other version which is very also very twisted is part of complete case history the kangroo at the seat of law may not be able to read both versions without thick ness of envelope delivered to his reader.
