bond for 500,000 for what ? it appears that your car will be released to you against superdari ?? your lawyer is criminal and facilitator with the other party.

it is your car, you registered the FIR, you have the complete correct paper work? Court if honest shall release the car to Punjab police respective police station against the case FIR. The police station will then inform you for the recovery of vehicle and local punjab court will process the case.

however stay calm play cool, ask the lawyer reason for surity bond, and time frame for which the bond is required, do not submit an open duration bond. It has to have a validity from xx.09.2020 to xx.xx.2020

The lawyer took a stay on the order from session court and the ACLC was unable to impound the vehicle.

You are absolutely right.

My lawyer was the main facilitator. He misguided me that the vehicle was impounded and it's under police custody. Whereas the car is still with the criminal lawyer. He went on blackmailing me to send him extra money because according to him all his work was done. His job was to get the vehicle impounded and under our custody. He did not tell us to this date that a stay order was issued the very same day.

I called the ACLC and they just told me that this criminal lawyer got a stay after 2 hours of the judicial order which was in our favor.

My lawyer knew that all along but he was facilitating the other lawyer by delaying tactics.

Hiring a new lawyer now from another jurisdiction because the local lawyers don't fight cases against each other.

Corruptness to the core is entitled to them and sucking on (Aam insaan) blood makes that a honorable profession

Registeration book was stolen along with the car.

File was issued illegally by excise to this criminal since he had the orignal registration book.

We have the cash receipt along with Excise order that the stolen car was transferred illegally and we are also the current owner since 2003 according to updated excise data.

Stolen on 02/09/12 and he applied for transfer on 07/11/12.

Technically I am not suppose to issue any bond for recovering my own stolen vehicle.

The vehicle is question is under our ownership

Actually I am the son fighting to get justice.

All the attested documents are in place.

Punjab police/MTMIS Punjab is in our favor.

Only major issue is that the vehicle is in a different province and the lawyers are protecting criminal lawyers.

can u involve local media in mardan? not with the purpose to defame someone but rather to let people know abt the facts and be aware and beware of mindset of lawyers and corroborating system.

also spend some time on citizen's portal, now u have a decision in ur favor you can use it wisely.

also make a summary and send to few news channels.

Brother, please don't mind but @capsat had earlier advised you to settle the matter through local bar association's intervention. I had also agreed humbly to this suggestion. But you didn't listen and confided in a local lawyer. You should have hired a lawyer from Islamabad. I would have assisted you.

I am sorry. I am not lowering your morale. But our society is too criminal. You have to be vigilant all the time.

Now done is done. Please hire a new lawyer from Islamabad to contest the appeal. Lastly, I don't know what kind of a stay is permissible in law after a lower court's order. A stay can be obtained from next higher forum (after listening to the appeal the Additional Sessions court could decide on the stay). So please do obtain copy of the 'stay order'. Your next lawyer shall need it for further proceedings.

Now the situation is clear.

Brother, you got it wrong. Lower Court order was issued in your favour on 24.09.2020, whereas the stay order has been issued by Sessions Judge Mardan (a higher forum than the lower court) on 26.09.2020, and NOT on the same day within 2 hours, as you have mentioned. During this time you were struggling to obtain a certified copy of the judgement. So it was not your fault, but the other party struck. Your lawyer wasn't that sincere with you but he had warned you that the other party would surely file an appeal against the lower court order.

Now, you have time till 03.10.2020 to engage your lawyer to represent you. The odds shall be in your favor only if you hire a good lawyer.

I guess the lawyer was favoring his "bradri". He said that it takes 3 to 4 days to get attested order whereas the other party got the order the very same day and they made an appeal. I believe I was played as my lawyer told me that the vehicle was impounded but unfortunately that was not the case and it only bought the other party time to strike back.

My lawyer is demanding more money in order to pursue further and to be honest I don't trust him now.
