Your lawyer is right. Try to take the car back to home at the earliest otherwise if the other party files an appeal in the court of Additional Sessions Judge (next higher forum) then the car shall stay in Mardan with the Police/ETO till finalization of the matter from this court.

The decision was in our favor as expected. Vehicle was impounded in court by Excise officials over in Mardan. Now we are in the process of obtaining NOC from home ministry in order for the Punjab police to get the car to Punjab from Mardan.

My lawyer wants us to get the vehicle back in Punjab ASAP because the other party plans on making an appeal.

Can anyone guide me on this?

On what basis will the corrupt lawyer who is accused of stealing a vehicle make an appeal and will he be able to take a stay on the vehicle?

to add more muscle to your case my suggestion is to prepare a summary since car was reported stolen make all points short not to exceed 3 lines with dates and reference numbers. last being the court order to impound the vehicle in mardan. there are 50 50 chances that a judicial magisterate issue a restraining order in KPK. The wasta wasela clan connections mafia gangs have inroads to our judicial system however if paper work is in place in order it will become quick sand for all such operators.

your 1st priority shall recovery of vehicle and repatriation to your area police station. Only after you get the vehicle back in your possession after court process in your district you take next step.

change the lawyer. a local with traceble base in your city file a case of damages with complete case history in high court bench of your town immediately make a deal with lawyer 50 - 50 for split of recovery. he will send the notice and upon 3rd decline of compliance the high court bench will become active. Model courts are hell speedy in all such fojdari cases.

Current update is that I had a meeting with the ACLC team yesterday which is ready to bring the vehicle back in Punjab, they need judgement order and case proceeding copy files in order to make a report and obtain NOC from interior ministry.

I called my lawyer just now and he was like that the other party will make an appeal 100% and asked me to send extra money on top of extra money that we initially agreed on otherwise it will take 3 to 4 days only to get the attested judicial order and copy of case proceedings.

My lawyer was suggesting me that I need to bring back the vehicle in Punjab ASAP on the other hand he is delaying and pressuring me asking for more money just to send attested order along with case proceeding file.

According to him his job was only to appear in court and its not his job to send me the judgement and required case proceeding files even though I am paying extra 10k on top of the initial agreed fee.

It looks like he plans on extorting as much as he can. I told him that your job is not finished until you provide me with the required documents. He was like "If they make an appeal and that they will" I won't help further so I told him that its you that is delaying so he was like pay extra and wait for 3/4 days.

I have a strong feeling that my lawyer is delaying this matter on purpose.

I already told my lawyer that its my hard earned money and I needed the required documentation ASAP to process this matter further and he told me to wait 3/4 days only to get a certified judgement copy and the other party would file an appeal and he (the lawyer) is done with his job, All other work from now on will cost me extra and he also wanted me to pay extra 5k to his "Munshi" on top of the 5k that I already payed in order to obtain the order and case proceeding files from the decision.

I don't intend on suffering further financial losses because of his Greediness

Give Rs. 500 /- to any other munshi of the Mardan kachehri and he shall fetch you a certified copy of the order. It's not necessary that you can obtain it through your lawyer only.

Your case number shall be required only.

You can can get certified copy of documents on payment of prescribed fee at Supreme Court Islamabad. There are also Branch Registries of the Supreme Court at Lahore,Karachi, Quetta and Peshawar. You can approach any of these Registries to apply and also receive the certified copies from there accordingly.

Court fee stamp of Rs.5/- is affixed upon every certified copy of Order/Judgment/document in addition to the folio charges. For folio charges upon one page Order/Judgment/document court fee stamp of Rs.1.86 is also affixed.

I don't think that you can receive the certified copies in the same day. It will take about 3 to 4 business days. Here is a video about getting a certified court copy from High Court.

Also, in case the criminal thief makes an appeal, get another lawyer to fight your case, if that is possible.

It is true that 3 works days are required to obtain a certified true copy of a judgement. Have some more of patience.

Halal & lawyer ? The term Halal applies only after they get accreditation for high court appearances. before that 98% doesn't want to know the word.

like i assessed earlier your lawyer is also hand in glove with other party. As you also mentioned both have same ustaad. Means the ustaad is also a criminal as well.

So far so good it is your effort and his appearance on your behalf in KPK court. Handle the matters with great care till such time vehicle land in your home. once it is in your possession , recharge and revitalize yourself then file damages in the punjab high court as other member suggested.

hire a reputable local lawyer who knows the trick of trade for such damages claim. Again as suggested be bold and tell lawyer no fee to b paid but 50 - 50 of whatever we get.

I received a copy of the judgement. The magistrate have written in the order that we can collect the car from Excise and taxation Mardan by providing surety bond worth 5 lac and bring it to Faisalabad. Let me attach a copy of it.
