I did request the magistrate but it was of no use.

The local favors each other over an outsider.

Anyways, I had previously considered it a total loss. However, everything turned out to be in our favor. After all (haq ka case hai).

I highly appreciate your concern but they don't have any power over me to either pressurize me or make any demands. Actually its the other way around now.

I believe the other party wants to get this matter solved by a jirga and of course I won't be paying a single penny to them. Infact I would want them to cover all damages and repairs after all they used my car for the past 8 yrs.

Yes. I have consulted with several lawyers and we have a pretty strong case. MRA and police department is fully supporting us. Only card for protection was supurdari order from the court which is making them untouchable.

As soon as the order gets cancelled which is expected sooner or later.

The other party will be left with no other choice rather than giving in.

The magistrate will give orders to confiscate the car/documents and issue orders for arresting the accused.

I have involved political influential locals now and its a justified case with all proof and evidences.

The END is inevitable.

JIRGA is illegal in A areas of Pakistan, as per constitution of Pakistan.
on Januray 16 2019 Supreme Court of Pakistan declared Jirga & Panchayat Illegal.
If the local magistrate / civil court judge suggest you any such thing you can ask for the legitimacy of such system.

prepare all your points and give it to your lawyer and see how he handles that. If he tries to convince or suggest anything not in line with the prevailing law & case status, ask him politely whose side he is on and what is his actual intentions.

Sir you are right. You are referring to the traditional jirga/panchayat system in KPK/Punjab. In these cases the decision is wholly solely taken by the jirga and both parties are bound to follow it, no matter what.

But there is an informal sort of jirga also, which we see quite frequently in our daily lives. For example, if you and I have a dispute over something, the two of us can sit down with a few persons of our community and try to sort out the issue by finding a middle ground. Although, in this case the same will happen but the magistrate and other party shall call it mediation or 'out of court settlement'. They will not call it jirga,deliberately.

I am sure the magistrate must have asked both parties this Saturday to 'decide amongst each other and settle the issue amicably'. No mention of the term jirga in it, you see.

Its more of a out of court settlement rather than Jirga. I was kind enough to the other party to let them know in advance that I'm about to take legal action so please don't have any gila/shikwa in the future before starting this legal process.

The person in adiala jail is the one who sold this vehicle to this lawyers nephew and according to the lawyer. He has his bayaan from 2016 when the vehicle was first impounded. He went to adiala jail and he told this lawyer that he bought this vehicle from someone else.

This guy is currently serving life imprisonment for forging someone else passport and tried to move drugs overseas. He was caught in the act and serving in prison.

Anyways, it's the lawyers problem not mine that he bought a stolen vehicle without proper verification.

It was basically a request made to the magistrate by this lawyer to settle this matter out of court. I was not interested in meeting unjust demands of purchasing the illegally obtained stolen vehicle back from the lawyer.

Out of court settlement with unjust demands is out of the question.

The lawyer says that everything is turning out to be in our favor.

Can anyone explain If this other party will be able to make this a civil matter and take a stay on our order? Its a faujdari case

no they can not obtain an stay for a stolen property. I assume that is why the members suggested you to prepare a document with social media chat you had with the stolen property owner.

if you have that done it can be produced in so called out of court meeting. I suggest do not not bow down take a firm stand. Allah will be on your side for sure.

The decision was in our favor as expected. Vehicle was impounded in court by Excise officials over in Mardan. Now we are in the process of obtaining NOC from home ministry in order for the Punjab police to get the car to Punjab from Mardan.

My lawyer wants us to get the vehicle back in Punjab ASAP because the other party plans on making an appeal.

Can anyone guide me on this?

On what basis will the corrupt lawyer who is accused of stealing a vehicle make an appeal and will he be able to take a stay on the vehicle?
