The situation is further complicated because the member has mentioned that 'ustad' of both lawyers is the same individual. In practice of law it usually means that they have worked as junior lawyers in the same chamber of a senior lawyer (whom they are calling their 'ustad'). In my observation lawyers of the same chamber have a strong bond and mostly they don't go aginst each other. And in instant case one of the lawyers is directly involved in the wrongdoing.

Just hope and pray that our friend succeeds in his efforts.

On my way back from Mardan right now. The other lawyer requested the magistrate for more time because his 'izzat' was on the line because gari chori ki hai . His respect is on the line because the car will be taken away eventually.

The magistrate moved his final verdict to 24th Sep coming Thursday. Everything is in our favor according to our lawyer.

In the meanwhile I will get the anti car lifting cell ready for the recovery trip to Mardan.

I met with the lawyer and he was persistent to invite us over to his village and wanted us to renegotiate and buy this vehicle back.

He showed me the new registration passport book and told me he got the car transferred directly from the 1st owners name.

The first copy book he did not have or did not want to show that had our ownership on it.

I also got to know that he bought this car from a person in malakand who is currently in adiala jail and serving 10yrs prison time for attempting to travel abroad by tempering and using another person's passport.

if you can find the name of that person and case number under which he is in jail you have a jack pot. At next hearing that can be a legitimate question from your lawyer. if & when the criminal respond to that next trump card of forgers case & sentence detail will turn table.

Please avoid any invitations for even a cup of tea or glass of water from criminal., at all cost.

The other party have already admiited in court. The car previously changed ownership with the guy in Mardan and they have admitted that stolen book file is under their possession.

Funny thing is that they know it's a stolen vehicle and they bought it from a proclaimed offender but still they don't want to hand over the vehicle to the orignal owners.

No, I was in fact replying to your question regarding the confiscation of the book/file and handing over to you. I was of the opinion that you would get it back through ETO concerned, not from the hands of the magistrate in Mardan.

Sorry but I think I missed something.

You mentioned that you were required to go to Mardan on Saturday (today) because the magistrate had to read out the decision of the case, and he wanted both parties to be present in the court. This is the final stage of the proceedings when arguments of both sides have been completed.

So my question; why is the other lawyer buying time now? Has he requested the judge to allow him to settle it out of court with you or what?

Without both parties consent the court cannot entertain this request. The magistrate should have handed over his decision of the case today. I don't know what is the missing piece of info here.

Yes my thoughts exactly, something is amiss here. Why the delay? Your lawyer should have raised his objection, what's to stop the other party to request for time again on 24 sep?

getting more time by the other party is effecting custody of car..

for example: car disappears...other party lodges FIR for car theft and ask stay from court till police investigation is completed..

in actual he drove the car to some area and sold for 150,000/-

plz let ur lawyer stay there on ur expense and ask him to make sure police keeps as eye on car n lawyer.

actually the other party should submit an affidavit for safekeeping of car to court with a bond worth car's value in current market...

The decision was supposed to be handed over. However, the lawyer requested and tried his level best to settle it out of court.

He was like Kay mujhay toh yeh gaari 11 lac ki perh gayi. Not my problem he should have verified that it's not a stolen vehicle before purchasing from a third party.

The new passport registration book was also tempered with and it had missing piece that was transferred vehicle on our ownership.

We were the second owner and It was transferred on our name in 2003 in orignal book. The red newer passport book told a different story. Direct transfer to the lawyers nephew bypassing our ownership.

Lawyers brotherhood I believe

They have to keep hola haath against each other it's against their bro code. Ustaad was involved also.

Lawyers from the same union/bar never fight cases against each other.

My lawyer also told me if he knew back then before filing the case. he might have never taken the case which involved a lawyer.

The car is out on the lawyers guarantee on bond worth 5 lac rupees. He is liable to pay in case anything happens to the car.

The other party case is very weak and his nephew have arrest warrants issued in punjab

We have the upper hand and according to police ddo when this car was impounded back in 2016.

This lawyer told the police inspector that he bought this car from his nephew in his bayaan when he was caught driving it and got it impounded

We have the power over to sack the lawyer aswell by serving arrest warrant to him since a stolen vehicle have been under his possession ever since

So my apprehension was correct. You did not raise any objection when the other lawyer requested for time for out of court settlement.

Brother, it's your car and you have been striving hard to get it back, who am I to tell you what to do. But I sincerely feel that you should have got this decision today by telling the court that you were not willing to give any more time/laxity to the culprit.

Now they shall try to pressurize you in different ways in the next few days.
