I've been reading the thread since beginning. My suggestion would be to avoid contact with other party as much as possible at this stage. Think about all the pros and cons, discuss with others about legal implications if deciding to receive vehicle directly since police have still not taken any action.

I agree, what ever they offer it should be in court or via police.

Do not agree to take custody elsewhere. They might create other legal issues. Never trust a lawyer. And the one who has been giving you so much trouble stay cautious

since you are legally following the case make it through procedure,
1. they shall hand over vehicle to KPK police and inform you date time and location of vehicle surrender
2. you shall contact the police station of FI R registration and inform the scenario
3. police shall recover vehicle from the police station in KPK bring back to faisalabad.
4. police report it recovered to you and respective court will process handing over of the vehicle.

5.date & timings are most important in such recovery.

I just want to get this done and get over it. Kind of fed up how the system and law is easily manipulated by the criminals.

Its too much of hassle for me Lahore to Faisalabad and Faisalabad to Mardan and then the reverse cycle.

I actually called him up and told him that It have started to look very bad in the eyes of law for you. I confirmed If this lawyer was his actual "Mamu" since he gave a written statement to ACLC back in 2016 when the vehicle was first impounded that he have bought this vehicle from his nephew.

Informed him that he will have to face at least 7 years imprisonment and then I sent him a copy of the police statement along with the updated ownership status of the vehicle and told him whatever he or the lawyer intends to do, this vehicle will remain ours and the Punjab police will soon have custody of you and the vehicle.

They see the arrest warrant coming I guess. They will try to settle it down by returning the vehicle and lure you in for a patch up.

Punjab Police have orders from the high ups to have this matter resolved at the earliest. The ASI along with 4 member team which was assigned by DSP/SPO 5 months back had directed the ASI to bring in the vehicle and criminals. Anyhow, the ASI to this date had not even make a single effort to obtain the NOC even though I have told him that I will pay for his services.

He is what you call a fine example of "Hadharam" and did not apply for NOC and other warrants to this date until I lodged a complaint on 8787 and Citizen portal and updated the higher ups of all the inconvenience that I had to go through because of his lazyness.

The thing is that the lawyer doesn't have to pay anything because he only writes up an application whereas I am facing all the trouble finding a "Honest Lawyer".

I have no plans to receive the car directly because It will get impounded in Punjab eventually and I will have to pay the police again to get its custody.

The police will recover the car from Mardan and I have asked the other party to withdraw the appeal and get the car impounded.

I have a very solid case. I will make sure date/time/location of surrender is noted by the ACLC. I will take custody of the car from Faisalabad when its done with all the court process in Punjab.

Punajb Police is currently in the process of obtaining NOC and arrest warrants whereas the (lawyers nephew) have asked 4 days time to make all arrangements to decide and return the car.

sir, the punjab police if willing, will just inform u that vehicle is traced in mardan and they need to goto mardan to take its custody.
then u have be the mighty force sponsoring all the travelling and lodging expenses of police party from fsd to mardan and back.
else they have 101 excuses to justify another delay of 100 years, the closest excuse is general election which are supposed to happed after 3 years.
so please remove this thing from ur mind that u wont have to spend anything to get the car back,

now if i were you, i wud have aimed for a bigger target to achieve smaller one.

for example, i wont even mention the car with police people, instead i wud press them hard to make an arrest or two...
seeing this the culprits themselves might make arrangements to send the car to fsd instead of themselves..

i dont know, if any terrorism clause could be added in this case or not, i know that if added then the culprits loose chances of bail and become ishtihari, kaisa dia apko? nahi dia acha?

I understand and completely agree with you, However, I am not certain why I would think or believe the recovery process will be for FREE.

Everything comes with a price, nothing in this world comes for free.

I left my focus on car recovery and pushed for arrest instead when the other party made the appeal. Fraud/Forgery/Theft is a big crime itself. The lawyer nephew is Isthiyari already and adding ATC clauses is neither required or do any good If it comes to settlement.

I will have to think wisely and not become reckless.

Giving up is out of the question and that is exactly what I explained when I called this person up. Actually he was the one that called but I was at work so I told him I will call when I get done from work.

I called him after work and told him politely that I am offering one final chance and afterwards all this matter will get messy and out of my hand. Sooner or later I will get my car back.

I previously came across this article, it is very helpful in understanding the jungle law and system that we live in. I have already spent around 1 lac 30 thousand on the recovery process.

One more thing to mention is that my complaint is under CCPO and PMDU supervision and this matter have already been delayed for so long that its been directed by the high ups that my application will remain active until I have possession on my car .

The day after I lodged the complaint that "ASI was not following DSP/SPO order" and all investigation done by me so far and vehicle location/criminal details have been provided to the police but the police officials kept on delaying the recovery.

The very next day the police station called at 2am in the night obviously I did not pick up because I was sleeping. When I called back they informed about the zalaalat they had to face because of non compliance on recovery.

The ASI also came running to my cousin office the very next day to get details of the criminals involved.

Then I agree with you completely to wait for the concerned authorities to get your vehicle back. Your efforts have been commendable so far. You should continue to follow up with the concerned authorities to get your vehicle back.

Also, you should consider calling NAB as the case is ripe with corruption.

Sometimes a point comes when patience is the best approach. May Allah Almighty help you receive your right and bless you for going through the ordeal.

If it were the west, you would have possession of your car without spending a single money It has made me realize we are not living in an Islamic land. It is a land ruled by thugs and munafiqs.
