Exactly brother. Hiring another lawyer was really not worth the hassle. Therefore, I decided to call and politely asked for safe return of my vehicle. I may have to arrange a lawyer back in Punjab to get the superdari If it all goes according to the plan.

I have just read this whole discussion today.. Brother you have really fought hard this battle but as is evident from the entire discussion you have been hoping for car recovery since jan.. And it hasn't happened yet.. And not to discourage you but if that lawyer intends to drag this case further he would easily do it by filing appeal after appeal in higher courts... I think once you had got the car transferred back to your ownership you should have filed for duplicate registration with ETO faisalabad and instead of waiting till now and expending on legal matters.. You should have gotten the vehicle snatched / stolen and brought back to faisalabad through some private party.. Once back in faisalabad the car could have been parked somewhere and got impounded.. As the car would have been impounded within punjab you would have easily gained back custody..

The thing is the car would have become disputed. I already have difficulty parking cars in my garage. It would have been stolen again and this game would have carried on forever

The car is already marked as stolen and I don't believe anybody will take a risk of bringing a stolen car all the way from Mardan to Lahore with the safe city project initiated its very big of a risk.

This case is in its last phase, iA the car will be under my possession very soon.

I don't intend on keeping that car forever but I do need my stolen property returned. It would depend on its condition If it is even worth keeping or not.

The car is already disputed till final verdict.. The difference is it would have been in your possession.. Plus now you are suffering due to punjab vehicle being in kpk.. If you had the possession this game would have turned around.. Anyways your case your decision.. Wish you best of luck

This car will eventually have to get impounded in Punjab. The FIR was registered before this lawyer even purchased this vehicle that too from a 3rd party. Its the state duty to bring in the non recovered stolen vehicle where the original FIR was registered.

Criminals have been nominated in the FIR already and the vehicle is not under the lawyers ownership neither he can claim it. Nor does KPK courts have any jurisdiction to hold this Lahore registered stolen vehicle once its claimed by Punjab Police. The lawyer arrest warrants are in the process and he has no authority to hold or claim the stolen vehicle or prove he bought this vehicle from us.

Also, I don't hangout or have any acquaintance with thieves who are willing to steal a vehicle from Mardan and bring a stolen vehicle all the way to (Safe City Lahore) If someone have a contact for whom he can vouch for to pull of this illegal high risk stunt. Do let me know.

No one is going to claim relations with criminals on this forum or any other .. But we all know in pakistan you can get anything done with a price... The car doesn't need to be brought to lahore.. It just needs to cross into punjab from kpk if anyhow possible..
As far as duty of the state is concerened.. Hasn't the state disappointed you throughout this case.. It has been 10 months since you got the car transferred back to your name.. But have you got it back despite being legal and rightful owner.. Leave aside getting it back its not even with the police... Despite a clear case have the nominated persons been arrested.. No they are walking free... And believe me that lawyer will drag this case to the high court as well just to frustrate you and force an out of court settlement...
I do sincerely suggest to sit down with a lawyer and assess the legal cost if the other party decides to use all forums of appeal.. Add to it the cost of recovering the vehicle.. If the cost isn't much then its fine continuing this line.. But if its not worth it do consider negotiating an out of court settlement

I think, again there has been a mishandling of the case.

The lawyer's nephew requested you to give him four days time to make 'arrangements' of returning the car. My experience tells me that these 'arrangements' are actually getting 'bail before arrest' for himself. (Since you had threatened him of consequences if he couldn't return your car.)

It means, when Punjab Police reaches him for making this arrest (which I highly doubt that they will) then the lawyer shall produce the ADJ's suspension orders of lower Court decision and bail before arrest papers, to the Police to avoid arrest.

Warning the culprit (whose uncle is a lawyer and party in this case) of arrest beforehand, doesn't sound a very good idea.

Still, I hope I'm wrong and this doesn't happen. But God forbid, if my apprehension is true then I sincerely advise you to fight it out inside the court and leave this arrest and threatening tactics.

The most disappointing thing exposed about our legal system is that even when everybody knows the car is stolen, the identity of true owner is revealed,, even then he hasn't got possession back just because the car is in a different province.. This is completely indigestible... And our govt is claiming to bring back absconders from UK..

Agreed. Actually, I feel sorry for the car owner for believing in the law or proper channels.
Here the law of the jungle prevails with the government officials the lowest category of animals.

That is the reason I never resort to the proper channels - court / police - to demand changes or request rights. This is not the UK or the US where the system is more logical and government people are humane.

I always deal directly with the other party or forget about it.

Pakistan is actually ruled by thugs and criminals. My father had persisted about doing CSS but I had rejected his advise. I knew the government system is corrupt and nothing more than a ruse by the 'elected' to rob people of their rights.

In these times, the only right course of action is to be patient and bear the system/loss or immigrate to a more sane country where rights of people are protected by the government.

Agreed. High risk job will cost too much. Well its disappointing to see the system favors the criminals. What can we expect when the system have been corrupted to its core.

This lawyer does not own this vehicle on papers but according to him he has bought this vehicle from his nephew and it have costed him around 9 lacs which is pure BS. His nephew was the illegal owner according to Excise and Judicial order and this lawyer has no right o claim this vehicle.

I have switched my focus on his nephew arrest along side 413 warrant for the lawyer.

Is it possible to get arrest before bail on 381 A Theft / 420 Fraud / 411 Dishonestly receiving stolen property / 468 Forgery and 471 using as genuine forged documents.

According to my information, the Punjab police plans on making an entry on the next hearing in Mardan to get the vehicle impounded and produce arrest warrants for the criminals. The KPK police will have to impound the vehicle and arrest the Criminals once NOC is issued.

Let's see how long they can avoid being arrested or keep possession of our car illegally.

Even If this untouchable lawyer avoids being arrested, his nephew will have to face consequences sooner or later because on papers he made the illegal transfer on his name and sold off a stolen vehicle to this lawyer after finding out its a stolen vehicle.

The guy just called and told me he is returning my car. He was like come to Mardan for next hearing and pay half of the amount that I payed to the thief and I was like " Why, did you pay me money to purchase my stolen car? I won't pay a single dime. Anyways, I made it clear to him that I won't be purchasing.

But please try to understand the concept. The culprit can be granted bail even for non - bailable offense if his lawyer is competent and pleads the case effectively. (In your case lawyer is uncle of the culprit.)

In our law people are walking scott free after committing murders (302). This is only a case of stolen vehicle and forgery.

Tell the culprit that you are considering his offer. And that you shall decide after seeing the vehicle.

And please do consider his offer after seeing the car's condition. Try to bargain, he may come down further. Do keep your options open.
