summerize the whole case with dates. hire a serious lawyer with supreme court license, file an application with lahore high court faisalabad bench against the mardan lawyer owner of stolen vehicle. claim damages in eight digit figure with generous heart offer your lawyer half if for any out of court settlement offer from the accused.

summary shall contain all annexures related to the case and conversations you had with the theif in jail and the owner offering asking you money for vehicle return.

make life miserable for him and put it up the case histroy without names and blurred photos of criminal over social media only after procedure is complete.

That approach will work and the lawyer from mardan will be on knees

I forgot to mention he also threatened me that he will keep on filing appeals on higher forums unless I pay him which is very unethical coming from a lawyer jo marna bhool chuka hai.

One more thing I found out during my visit was superdari law is not being implemented now. being said that this leaves him with no valid reason for this crooked lawyer to drive our stolen vehicle.

We requested the judge not to postpone the judgement but the corrupt lawyer said his lawyer wasn't present therefore the judge told us I will have to delay the order otherwise this corrupt lawyer will appeal that he did not have a lawyer present to defend and he did not listen to his stupid argument.

I told the Judge the conversation I had with this corrupt lawyer and how he wanted to sell me my stolen vehicle and how he only wanted to waste our time also about his advise on calling a jirga to settle this matter. The judge had a clear understanding of what was cooking and he had an idea of the actual motive of this corrupt lawyer. he asked him who the hell are you to claim the superdari for this vehicle. Are you the owner? he was like NO but I purchased this vehicle from my nephew. I told the judge that nowhere does it says on registration that he is the owner and his nephew deals in stolen vehicle which is a crime itself. He has no right neither does he have the ownership. His nephew is WANTED by the police as well as MRA/Exicse is also searching for the vehicle. The judge told him to bring his nephew on the next hearing for the final order.

The lawyers went on strike till 27th october.

The final hearing and order will be issued on 28th october. Also we told the judge that how he was threating us that he will keep on filing appeals and wanted to sell us the stolen vehicle. We also requested the judge that this lawyer also did not get this vehicle in custody even though order was issued.

The judge asked him why hasn't this vehicle been impounded yet even though order was issued? To that he started waving the "new red registration book" to the judge that I have the ownership and my nephew is the owner of the vehicle.

To that I answered Its a forged bogus registration which can be confirmed by Excise and presented the judge the older registration copy and requested the judge to tell him to present the original registration copy of the vehicle and I also presented the MRA order that have accused his nephew for forging papers.

We told the judge that we won't be able to come to the next hearing, we have presented all proofs/evidence maintaining our ownership. This lawyer can bring whatever lawyer suits him best on the next hearing and argue his case. We told him that jo haqq ka faisala hogay hamay manzoor hai.

Rest police will investigate the matter once the car and criminals are in custody.

We also presented the ETO Mardan order that they are ready to impound the vehicle and they have given notice to this corrupt lawyer nephew to present his case in Excise office on 28th October failing to prove his authentic ownership will make him face consequences and a case will be registered against him.

When the lawyer was trying to negotiate with me I asked him where the orignal registration copy was since it entailed our ownership to that he said the Excise ripped it apart when they issued the red passport book

And instead of relying on Punjab Police (to recover the car and arrest the criminals), you presented yourself in the Court to explain your position. Great move. I agree with UAHMAD that you have taken an active approach instead of relying on the Punjab police to get the vehicle back. We had given up hope as we thought you were waiting for the police to take action.

The system officials are like donkeys. You need to use all the means possible to make them move like using the right resources.

If possible, get help of a local MNA or a person with connections to impose the order of the judge.

MRA Mardan ETO and his team was very helpful + they also had to clear their name. They don't need to wait for the judicial order because they have the power to impound the vehicle.

The vehicle is now wanted and 3 days time have been given to these criminals to prove if the transfer was legal and authentic.

This greedy lawyer and his nephew will have to face the consequences. BTW another 50k spent on the trip

Again I gave both of these greedy criminals a choice and a way out by returning my vehicle instead they wanted to rip me off. Now I will drag this case to the very end and make them pay for it.

The federal warrants are also in the process.

Thank you so much. iA they will pay for it and this lawyer nephew is a government employee. Trying to source out where he works so I can deal with him accordingly. Many times I tried to resolve this matter in a polite way but like they say ' laato kay bhoot baato say nahi maantay '.

When red book was introduced in 2012 the early transfers in those days has that case .. for couple of months initially ( oct/nov/dec 2012 ) excise did not returned those books and later they started giving old book back to owner. This is confirmed as i came across such a case recently where the car was missing the first book and johar town lahore ETO confirmed this thing ( i was there personally to check about documents )

I might have relied on Punjab Police but brother UAHMAD suggested me otherwise so I followed his instructions. Its about to be 6 months now since DSP/SPO office issued order for arrest of this criminal along with recovery of the car to ASI 4 member team. However, the ASI seems to be a big raashi and he was suppose to get the federal warrants before 21st October but as expected federal warrants are still pending but will be issued any day.

Complaint on 8787 and Citizen portal lodged.

So the Excise dept. did return the original registration book. In my case the original book had our transfer on it. However, it was bypassed somehow. Inquiry is in process. Will keep you all posted.

I remember one time I went with my friend to buy a 2010 Corolla. This Car had all the documents along with the new red book but the original book was missing. The Exicse people hesitated and did not transfer this vehicle on his name. We had to return that vehicle.

One more interesting thing I found during my trip was this vehicle was first transferred in Mardan in 2012 only after one month of being reported stolen and ownership certificate was issued and once again in Lahore after one year in 2013 this stolen vehicle was transferred and file was returned to him because he had the ownership certificate..

in case of any theft case, our police has this famous verdict, APKO KISI PAR SHAK HAY, hamein batein haum abhee jaker usko utha kar le atey hain.

in ur case, u have already identified the culprits, still they wont do anything......

only if u have some one in active military service, who can spare some time and goto the highest police official of ur areas, or even call the police to his office, then there can be some rapid progress, still u have to finance all activities to be undertaken by police...

in Lahore, i knew a friend in Police who was deputed to set up a new thana or chowki, i still remember he used to pay the telephone,electricity and fuel expense from his own pocket to run day to day police operations..so it is like that...

This lawyer have a very low self esteem and no respect for himself nor his family. He knows very well that Its a stolen vehicle and still persistent on selling it back to us even after using/abusing this car for the past 9 years.

I got to know from another lawyer that the vehicle is neglected. Aakhir chori ka maal hai

I gave him a way out but still he kept on blackmailing us that he will keep on dragging the case by making appeals on higher forums. His age is approximately 60 to 65.
