Ownership of car

Assalam O Alaikum. Unfortunately, I have lost my father. We have a car registered on my father's name. Now is it necessary to transfer that to my name or let it go as it is or what if we want to sell that car? is it possible or not?

if the id card of your late father is valid, contact an agent transfer the car under your mother's name.
sell it later.

if you choose the method mentioned in blog, you will be in a spin for very long time. It is a moveable asset and can be managed in plain sight. am sure no heir will have an objection for transfer to sell later for distribution of heirship by mother., unless the mother feels unsafe and become biased for an individual.

am sorry for being so arrogantly rude, however am going through such mediation. Nobody was willing to trust anyone, so the vehicle is transferred to my mother - no blood relation but just old time neighbor (all agreed signed the paper). Vehicle is up for sale am expecting deal closed by Friday. My mother will distribute the money among 1 widow and 5 orphans (3 boys & 2 girls) through the bank cheque.

Being a movable asset, I don't know about the laws of Sindh, but in Punjab, I believe that a succession certificate needs to be made listing all movable properties including cars. Of course as @capsat is actually going through this mater and is in the best position to advise.

for fixed assets as in property etc & bank accounts there is proper legal documentation work required, from the court through the lawyer.

prepare list of fixed assets / bank accounts under the deceased name as per Govt records,. Obtain an FRC from the NADRA. everyone part of the FRC will then nominate an administrator (within the FRC or someone trustworthy to all) for disposal / distribution of heirship shares. a lawyer specializing in family heirship issues can guide further.

I am also going through the same situation. Regarding land and car.

irony for me & my mother is that we are the outsiders, the connection is neighborhood for 40+ years, got invited to resolve the heirship dispute. The only issue as human i noticed is trust deficit among the widow & her children. Otherwise Shariah is very clear for shares.

Brother, For FRC we must have the death certificate from the Union counsel, right?
Someone told me not to apply for the certificate before doing paperwork on the plot because it increases the chances of Possession by the land mafia.
Did you have any any idea or have any information related to this?

Death Certificate is issued by union council.
FRC is issued by the NADRA.

it is high time you shall engage a competent lawyer. Big Names have high consultancy fees but their chambers get priority treatment at the respective courts.
