1)In 2006 SC has already ruled out as illegal all commercial activities in public parks
2)Even CDA's own constitution did not allowed construction of ANY commercial building in the same park at the time of lease making the lease void ab initio.
3)The area was leased at a petty amount of 300,000/month with connivance of corrupt officials.
4)The park is a public property and any auctions/lease of land, even if had to be done, must be by way of a public hearing i.e. general public must be invited and given a chance to become the leaseholder. The highest bidder wins, as simple as that. No auction/puclic hearing was done in this case. The land was leased quietly to M/S Sizza Foods hence depriving the competition and public in large of a chance to lease the same land
