A suggestion. Not everybody is around in islamabad to participate or help. Once legal things r clarified, u people may setup an account where everybody can chip in some amount to help resolve financial matters. To settle 100 or 200k for a group of people is not a big thing especially for a greater good of all.

Dear Farook, Did you checked with any other senior lawyer as well. One of my colleague checked with his friend feather who is a senior lawyer and he said that LHC decision is applicable in whole Pakistan. So you guys dont need to appeal separately. Also according to him the matter will be handled in supreme court anyway as two different high courts have given two different decisions.

Because otherwise someone can go to Peshawar high court and get a different decision and in the same way in sindh as well.

Can you check for a second opinion.

Yes you are right but numbers are not being made available in Lahore. Until the stay order thing is confirmed and order is issued.

1 lac is not less but yes less than the amount of vehicle. Plz do confirm from some other lawyer as well coz I think 1 lac is too much for the appeal. How would any poor man in any other case appeal if its really 100k.

Although the lawyer here in Lahore said it'll take a day or 2 but I'll try to push him to get the copy of stay order tomorrow.

I am not sure if an end-user can be a part of appeal or not. But if you are going to file an appeal then I think your appeal will later automatically be joined to that of FBR as usually 2 different parties in the same case are heard together as a single case. This will make the case much stronger.

Did you had a chance to grab the Stay Order copy. Also did you confirmed from your the same lawayer if LHC decision is applicable in the whole country. Because even in LHC stay order the judge is ordering FBR not to take any action against the car owners. So FBR is being addressed in both the cases. I believe the order will be applicable in whole pakistan in this circumstances.

yup ... mujhy bh yehi lagta tha phelay fil shor machaya nahi vo sirf punjab main lagta hai tu chup kr gaya.... but jb suspend kiya tha IHC order LHC ny tu tb bh wasay Isd excise walon ny number nahi kholay thay.... letss cc kya banta hai...

Today called in FBR Legal wing,they say FBR has decided to file an appeal against the decision in supreme court.and there is time for 02x months to file an appeal.Also he said that Lahore High Court has already issued the stay order against the IHC decesion.He further said that people who have the cars can drive them without any problem,since FBR has decided in principal to defend its case and not take any action against the cars.However those cars which are not registered may face problem at the hands of police as all applied for cars have to, irrespective of Amnesity scheme or not.

Further stay order of LHC will be applicable across country as was order of IHC.latest order will have precedence irrespective of any High Court.

Thats good. But still even in that case FBR may only defend themselves but not the people who purchased the car. Becuase the problme is that even if Supreme court or any other rules out that the scheme was illegal so government and FBR should pay the price not the end common user. This side of the picture needs to be highlighted.

Abhi kal hee unkle ny btaya ha ky Sales tax par amnesty scheme di ha. to aisay tu har scheme challenge honay lag jaye gi.. Asly they have to prove thereself plus IHC ka judge ko shok hota ha ky aisi decisions dy js sy aosay fame milay lyk musharraf case,pcb chairman case and this amnesty scheme case. I think Fbr also include common people prob in its case nd also include stayorder in its case.

Yes but they are actually trying to defend their order. We have nothing to do with that order... when we all purchased vehicles they were legal so we should not pay the price even if the order has been declared illegal. I believe we need to apply to be part of the petition and that can end up giving us good results.
