What is biometric?

A person told me that to sell a car now, the seller only needs to provide biometric now and stamp paper is no more neccessary. Purchaser hands over money and seller provides biometric and no need to sign stamp paper now. For islamabad. Is this true?

Yes, it is for quite some time now, but there is no problem in making a stamp paper and getting it signed for proof about buyer and seller.
Biometric is basically the seller's information (the name of the person the car is registered to) saved against that person's fingerprint in NADRA and is valid for 60 days (02 Months) which is required for the transfer of ownership in Islamabad''s Excise Office.

That what i thought too but a person was selling his car, i was buying. The car was not in his name and he did not sign a stamp paper with previous (first owner) owner because it is his relative. Now he says i will sign stamp paper and not the first owner(car is on first owner name) and will give you his biometric. It doesnt seem logical to me. I told him i need sign of owner of car on stamp paper. He says no i will give you biometric and that works.

Yes, that seems okay. If the stamp paper is signed by that person who's selling you the car and he will also provide you the valid biometric of the first owner (whose name the car is registered to), then it's okay. I don't think that there is any problem in making this deal if all the other documents of the car are clear.

The rest is your personal choice.

This is for transfer of ownership only

For transfer of ownership, YES, it seems to be true, i.e. provide to the buyer the Biometric slip (which hold valid for 60 days from the date of issuance), and also sign different forms (available, or downloadable from Excise and Taxation, Islamabad website) for transfer of ownership, however, as a proper proof of sale-purchase, I am an old school type guy, and still of the opinion and favour that, stamp paper must be signed between the seller and buyer (preferably in the presence of 02 witnesses) as a proper proof of the deal, and irrespective, if its reqd. for the transfer of ownership or not!

To further explain, if there no such thing exists, you receive the money, give him your Biometric slip, smart card and license plates in original, and sign the forms for transfer of ownership, and you do not have any documentary proof with you that you have sold the car, then what if he never goes to the Excise Office for transfer of ownership?

What if the forms get lost, stolen, misplaced, etc.?

What if you also do not have any photocopy of the signed transfer of ownership forms? (even if you have them, I do not think they hold any / all legal importance)

If you'll not have any documentary evidence, GOD Forbid, if something goes wrong, whole responsibility may fall on the seller.

I know, at the time of sale / purchase of vehicle, the parties involved are super excited, and may avoid going for all this, however, these things are there for the betterment of all concerned.

So, I am of the opinion that stamp paper must always be signed between the seller and the buyer. Seller will retain its photocopy, and buyer will keep the original with him.

And...

Never sell the car on Open Transfer Letter! Whatever the buyer says, and whichever lucrative offer, buyer gives!

YES. It can work as long as Biometric slip is valid.

Although it can work, still, its better / preferable to buy a car from the person, who at the time of selling, is also the current owner of that vehicle, with everything neat and clean (i.e. clean docs, biometric slip, license plates, etc.)

Its best to establish ownership of the vehicle at the time of selling / buying.

It saves one from lots of hassles (if they have to appear in future).

It doesnt seem logical to me. I asked myself how can a person sell a car that he does not own and proof of ownership is an official document (car papers or a stamp paper) and not a "wo mera rishtydar h mene us sy li h car".

If i buy a car from someone who is not the legal owner, meaning there is no document that shows that person owns the car, wouldn't that be illegal? Even if he does provide me with biometric.

I can sign an agreement with the seller and give him money but he is not the actual owner. Can the actual owner not claim that the car was sold without his consent? Even if someone has a biometric of real owner, how can they sell a car that they do not own?

YES. You have very strong, logical and reasonable points, however, sometimes, other things and factors can matter too.

Again, let me give my example (may be, it clarifies a few things):

When I bought my current ride, it was not on the seller's name, rather on the name of the person from whom he had bought it.

When we inquired about the owner, he said that the owner is his neighbor and he had made stamp paper deed with him (and he was true. Both the seller, and the person from whom he had bought it, lived in same street of E-11, Islamabad, their valid CNIC copies also spoke it. Regarding checking the stamp paper / deed between the seller and the owner, we didn't demand as it did not seem right to us).

Then he provided us with the Biometric slip, and smart card in original; the signed forms by the owner for transfer of ownership, copy of CNIC. I made the complete payment, and then visited a stamp paper vendor. We made the deal on stamp paper, with each and everything mentioned, the different terms and conditions, etc. and I managed to have it transferred in my name without any issues. AL HAM DU LILLAH.

Sometimes, seller's personality / impressions can also count. If the seller looks decent and modest, he calls you at his home / house to check the car, his house seems good and at good society, he serves you well, the locality / society is good, etc. then these can be some markers that the person is good, and worth making deal.

Although its not the Best practice, and I am not supporting / favoring this practice. Again, I would reiterate that best is to buy the vehicle from the person, who at the time of selling the vehicle, is also the owner of that vehicle, so that everything goes smoothly, but if, conditions are slightly different, then proceed accordingly, but vigilantly.
