Zindagi main kabhi bhi kisi ki baat ka yaqeen us waqt karain, jab woh aap ko uska thos saboot bhi day sakay.
Ask that dealership guy to show strong evidence in writing, if any, to substantiate his claim that the government had withdrawn that penalty clause, if customer wasn't delivered his car within the tentative delivery date.
Nevertheless, sharing my personal experience, I wrote one strong-worded email to Suzuki high-ups last week, with cc to Ministry of Industries and Production (Public complaint cell), explicitly asking them to deliver my car within the tentative delivery date, otherwise pay compensation, under clause 6 of ADB. I also attached dealership signed & stamped:
i. Pay Order receipt and
ii. PBO form, issued by Suzuki
I never expected any reply of my email from Suzuki, but to my utter surprise, the Sales Manager of the Suzuki dealership called me the very same day, asking if I wrote any such email to Suzuki high-ups. After my affirmation, he politely assured me not to worry and that I would be given delivery within the tentative delivery date.
PS. Automobile manufacturer isn't bound to deliver within 60 days, rather it is bound to deliver within the tentative delivery date, mentioned on confirmed PBO.
