Ok guys. Here are few things.
From all the news, talking to the agent and the lawyer in Lahore and then my cousin lawyer here is what I have understood.
Owners of these vehicles in Islamabad need to gather on a single platform. Plz at least one of you should contact others, ask them to make a contribution in the lawyer fee. More the people less the financial burden of the fee and try getting a good lawyer.
IHC order has been issued by a single Judge bench. Now the owners can file the intra-court petition in IHC in 3 judges bench, same way FBR is planning on doing. I think the single judge who gave decision cannot be part of that bench. Its useless waiting for someone else to come forward. In its decision IHC is supposed to have given the time period for the appeal. skyrider361 wrote above that he has heard its 21 days. File the intra-court before that.
For Punjab now. IHC decision came out on 19th June. Registration process in Punjab remained suspended from 19th June to 26th June. The verdict was challenged in LHC on 27th June. LHC suspended the verdict of IHC and called the concerned departments' officials to court on 24th July. Within half an hour the process of registration for amnesty vehicles started in Lahore on the same date (27th June). I got my car registered on 28th June. However, E&TO guys said that book will not be issued till case is in court. Actually the suspension of the verdict (or stay order) was not confirmed and was temporary till 24th July (date of second hearing). On 24th July there was the second hearing in LHC. That day the stay order was confirmed. Confirmation of stay order means that the court heard the initial arguments by both the parties and felt that the case is worth hearing and the IHC verdict needs to be judged again so stay order was issued till the case is in the court. However getting the stay order doesn't mean the case is in owner's favor but for now the vehicles in Punjab are safe. According to my agent now most likely I'll get the registration book, but he is not cent percent sure. The lawyer that I talked to also said that its a good thing that the stay order has been confirmed.
Now coming to some technical points.
1st, no, if you don't go to court in 21 days order will not be implemented in the whole country. Appeal against the decision is already in LHC so it may affect Islamabad after 21 days but not Punjab.
2nd, jamionline wrote above that people in KPK have got the books. I am quite sure people in Balochistan will have also got the books. IHC was established in 2010 because Islamabad is the federal capital and doesn't fall in Punjab technically so it was made to deal with the cases in federal capital (although actually it was established by PPP govt to destabilize PML(N) govt in Punjab). If the provincial govt of the province chooses to ignore the decision of the IHC then I am not sure what would be the result. I think that's what KPK and Balochistan have done. They may raise the technical point that their province doesn't fall in the jurisdiction of IHC and will only follow the decisions of the high court of the respective province. If IHC says that as it is in federal capital so verdict applies to all the provinces then one is justified to ask what is the role of Supreme court then if IHC is gonna implement its decision on whole of the country, and if seen technically, IHC has exceeded its jurisdiction in this case.
Let me explain like this. When amnesty cars were 1st registered Sindh High Court ordered that the taxes for the past years during which the car was illegally in Pakistan should also be collected at the time of registration. But that order was only implemented in Sindh and not in other provinces, because other provinces did not fall in the jurisdiction of SHC. Although order was suspended as someone filed the appeal.
In the end, skyrider361, plz confirm if Balochistan govt has filed the case in SC. Although speaker Balochistan assembly asked Balochistan govt to do so and it was all over the news but I haven't got any news if it has filed the case in SC or not. If it has then its the best thing coz SC decision applies to all the provinces. If LHC declares the vehicles legal, it will be for Punjab only, not for federal capital or other provinces.
